+39 393 8909 241- Part I: Scope 1.1 These General Terms and Conditions of Sale (GTC) apply to all orders for curtains, mosquito screens, and other custom-made items placed in accordance with the customer’s instructions submitted via the website www.orstores.fr and constitute an integral and essential part of the contracts entered into by the customer with ORSTORES.
1.2 In the event of a conflict between these Terms and Conditions and the terms and conditions agreed upon in writing for each sale and set forth in the confirmation email sent by ORSTORES, the latter shall prevail. In the case of contracts entered into with consumers, these Terms and Conditions shall apply to the extent they are consistent with the special provisions of the Consumer Code, which are expressly incorporated herein.
1.3 For the purposes of these Terms and Conditions, the customer is the person identified by the information provided upon acceptance of these Terms and Conditions, who configures, orders, and purchases the product that is the subject of the contract.
1.4 For any questions regarding these Terms and Conditions, product specifications, specific terms, or any other matter, customers are invited to contact ORSTORES directly using the contact information provided above.
1.5 The current version of these Terms and Conditions is always available on the website www.orstores.fr
- Language of the contract and applicable law 2.1 Regardless of the different languages in which the www.OR STORES.it website is displayed, contracts entered into with OR STORES are concluded exclusively in Italian and are governed exclusively by Italian law, to the exclusion of any other law. 2.2 Orders are placed by the customer using the guided procedures available on the www.OR STORES.it, which allow the customer to select the general product categories and specify the specific characteristics that OR STORES will follow for the custom manufacturing or personalization of the products. Therefore, OR STORES cannot be held liable for any errors made by the customer during product configuration and, in general, during the completion of the purchase order.
2.3 The purchase order is considered to have been completed correctly if, after completing the submission process, the website does not display an error message.
2.4 By clicking on the “Submit Order” button, the customer makes an irrevocable offer to OR STORES, in accordance with Article 1329 of the Italian Civil Code, regarding the items in the shopping cart. After the customer submits the purchase order, OR STORES will promptly confirm receipt of said order at the email address provided by the customer.
2.5 In accordance with Article 13 of Legislative Decree No. 70 of April 9, 2003, the order confirmation email contains a summary of the general and specific terms and conditions applicable to the contract, information on the essential characteristics of the purchased items, a detailed breakdown of the price, payment methods, the right of withdrawal, shipping costs, and applicable taxes.
2.6 Upon the customer’s receipt of the order confirmation sent by OR STORES, a binding contract between OR STORES and the customer shall be deemed to have been concluded.
2.7 In compliance with the consumer information requirements set forth in Article 52, paragraph 1, subparagraphs (f) and (g) of the Consumer Code, and in accordance with the provisions of Article 55, paragraph 2, subparagraph (d) of the Consumer Code, the right of withdrawal is excluded with respect to the purchase of items made through the website www.OR STORES.it, as these are goods clearly custom-made by OR STORES for its customers. The items may therefore not be returned or refunded.
- Prices, additional fees, and payment terms 3.1 OR STORES reserves the right to change the prices of items sold on the website www.OR STORES.it at any time. Customers are advised to check the final sale price of the selected item before placing an order with OR STORES.
3.2 The prices listed are retail prices, including VAT and other taxes, except for shipping costs charged by the carrier selected by OR STORES, which, if applicable, will be specifically indicated.
3.3 Unless otherwise agreed, the customer shall pay the full price of the items ordered at the time the order is placed on the website www.OR STORES.it. OR STORES reserves the right to deliver the purchased items only after receiving full payment of the price.
3.4 In the event that an item is unavailable, even temporarily, OR STORES will promptly notify the customer by email at the address provided at the time of the order and will refund any advance payment to the customer within 30 (thirty) days following the day after the order was placed and payment was received.
3.5 OR STORES shall in no event be held liable for any malfunctions in the electronic payment services provided by third parties and made available on the website www.OR STORES.it.
- Shipping Options 4.1 The ordered items will be shipped to the customer by OR STORES using a carrier of its choice. OR STORES undertakes to deliver the items to the carrier within 7 (seven) business days from the date of order confirmation, provided that this period shall begin on the date of payment if payment is made after the order is confirmed.
4.2 OR STORES shall not be liable for non-delivery or delayed delivery if such non-delivery or delay is due to force majeure, such as—for example—strikes, government measures, restrictions or shortages of energy or raw materials, transportation difficulties, fires, floods, or damage to industrial machinery that is not attributable to OR STORES.
4.3 OR STORES will notify customers in a timely manner of the occurrence and cessation of a force majeure event. If the force majeure event persists for a period exceeding two weeks from the shipping date originally indicated in the order confirmation, either party may terminate the contract.
4.4 In the circumstances described in the preceding paragraph, the customer shall not be entitled to any refund, compensation, or price reduction of any kind, except for the right to a refund of any payment already made toward the price in the event of termination of the contract.
- Warranty 5.1 The statutory warranty provided for in Articles 129, 130, and 132 of the Consumer Code applies to purchases made by customers classified as Consumers. In the event of a lack of conformity of an item in accordance with Article 129 of the Consumer Code, the Consumer is entitled to have the item repaired or replaced, free of charge, within a reasonable time. For purchases made by a customer classified as a Professional, the statutory warranty provided for by the Civil Code applies.
5.2 OR STORES shall not be held liable for any material or immaterial, direct or indirect damage that may be incurred by the customer, their property, and/or third parties as a result of the improper or abnormal use of an item, or defects in the installation of an item, which remain the sole responsibility and under the full liability of the customer.
